These Terms and Conditions ("the Terms and Conditions") govern your ("the User") use of the www.nunabean.co.za ("Provider") website located at the domain name www.nunabean.co.za ("the Website"). By accessing and using the Website, the User agrees to be bound by the Terms and Conditions set out herein.

The use of any product bought from www.nunabean.co.za is at the purchaser's risk. The purchaser/user indemnifies and holds the Provider harmless against any loss, injury or damages which may be sustained as a result of using the products sold on the Website.

Except as specified in these Terms and Conditions the User is not granted a license or any other right including without limitation under Copyright, Trademark, Patent or other Intellectual Property Rights in or to the Content. This Website and the Content may not be reproduced, duplicated, copied, resold, visited or otherwise exploited for any commercial purpose without the express prior written consent of Provider. The license does not allow the User to collect product or service listings, descriptions or other information displayed here, and does not allow any derivative use of this Website or the Content for the benefit of another merchant. The User may not frame nor use framing technologies to enclose the Provider Website or the Content nor any part thereof without the express written consent of Provider. Provider and the Owners do not offer products or services to minors. If you are under the age of 18, you may not respond to or otherwise accept or act upon any offers in the Website.

Delivery Policy

Subject to stock availability and receipt of payment, requests will be processed within 24 hours and handed over to our courier company for delivery. For very remote areas not serviced by standard couriers, the Provider will deliver via Post Office, or to the nearest town to the User that is accessible by Berco Express within their normal routes. In these circumstances the Provider will be in contact with the User to arrange an alternative address. The Provider will supply all goods to the delivery company in good order and will ensure that goods arrive at the User's chosen delivery address in the same good order. Cancelled orders on the e-commerce facility will be refunded after deduction of a 15% charge for administration costs. The Provider reserves the right to cancel an order for which payment has already been received. This may occur if for whatever reason we have run out of stock. Should the Provider exercise this right, the User will receive a full refund with no deductions.

We try our hardest to have your shoes at your door for South African based customers within 48 hours and foreign based customers within 7 days depending on location. If we say it's in stock, we're right 94.2% of the time. If for whatever reason we've made a mistake, we'll fix it. If you cancel your order for any other reason, we have associated costs with various people in our supply chain and sometimes we need to pay them. We'll do our best to help you avoid costs.

Returns / Refund Policy

If you have used a product and found it to be damaged or faulty we will collect the product at our expense and either replace, refund or repair the item, depending on the circumstance. Although seldom charged, we reserve the right to charge a 25% administration fee for returned orders should the returns process incur significant administration expenses.
Online Refund and Exchange Policy
If any of our valued customers are dissatisfied for any reason whatsoever with any item bought online, you are able to return it by contacting our Online Store at 083-8393570 to make arrangements for the collection of the item and delivery of a new item you want to exchange it for.

Returns will only be considered within the first 14 days from the online purchase date.
A refund can only be considered if the conditions of Nunabean’s refund and exchange policy have been fulfilled.

Nunabean will exchange or refund the cost of the product on the following conditions:
1. The original Online Order is provided by the customer;
2. No in-store exchange or return will be granted without proof of identification and online purchase receipt as all returns need to be checked and verified by Nunabean;
3. Returned products must be in the original condition and in undamaged packaging;
4. No refunds or exchanges will be considered for a product that has been misused or purposely damaged;
5. A faulty product will, where relevant, be subjected to a technical assessment by a specialist before being repaired, replaced or refunded;
6. Repairs may involve a courier cost that is for the customer’s account and will be quoted upfront;
7. When returning a product for repair, please ensure that it is hygienically clean;
8. Any online order errors mistakenly made by a client can be returned to Nunabean. A standard courier fee will be charged for collections which will be discussed with the client beforehand. Agreement will have to be reached by both parties before any arrangements can be made for collection by courier;
9. Exchanges will be made on the price the customer paid unless there has been a national price decrease due to end of ranges. This will be handled on an individual basis through our customer service center and may result in a lower return value.

Exclusions on the condition of Online Refund and Exchange Policy
+ With respect to products that are found to be faulty or misrepresented by the manufacturer: all returns of this nature will abide by the manufacturer or importers returns policy. Both Baby Boom and suppliers reserve the right to test all items before any decision is made with regards to the return/exchange;
+ The item was not used for the intended purpose of the product;
+ Instructions of the product were not followed;
+ Products damaged due to negligence;
+ Products not in sealed, original, undamaged packaging-this includes items assembled;
+ All products which comprise foodstuffs, beverages, or other goods intended for everyday consumption, this includes but is not limited to all formula, juices, foods;
+ Where the products are personalized or made to the customer’s specifications or where products are manufactured for the customer;
+ Where the products are perishable or will expire rapidly;
+ Where the products by reason of their nature cannot be returned; this includes but is not limited to all items of a hygienic nature, underwear, breast pumps, cosmetics, potties, as well as safety products including but not limited to, car seats and all medication;
+ Any reading / Audio material sold;
+ Any “end of range” items;
+ Items tested and found to be in working order;
+ Christening clothes.

International Refunds
1. Banking fees on International refunds varies and will not be covered by Nunabean;
2. All International refunds are subject to the price of the South African Rand (ZAR) and other exchange rates. This can affect the refund negatively;
3. International refunds can take up to a month (30 days) to clear due to the different banking systems and international transfer delays.

Credit Card Acquiring and Security

Credit card transactions will be acquired for the Provider via Payfast (Pty) Ltd. Payfast uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no credit card details are stored on the website. Users may go to www.payfast.co.za to view their security certificate and security policy. On proceeding to purchase your goods, you will be redirected to Payfasts secure site to complete the transaction. The Provider does not keep credit card details for any customer. The Provider cannot be held responsible for security breaches occurring on the User's electronic device (personal computer or other electronic device used to browse the Website), which may result due to the lack of adequate virus protection software or spyware that the User may inadvertently have installed on his/her device. Customer details will be stored by the Provider separately from card details which are entered by the client on the Payfast secure site. Payment may be made via Visa, MasterCard, Diners, PayPal or by bank transfer into the Provider's bank account, the details of which will be provided after checkout. The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).

It is the User's obligation to periodically check these Terms and Conditions at the Website for changes or updates. The User's continued use of this Website following the posting of changes or updates will be considered notice of the User's acceptance to abide by and be bound by these Terms and Conditions, including such changes or updates.
